GRAND RAPIDS, mich. (WOOD) - A Comstock Park teen charged with threats of terrorism against his school and some classmates will soon be transferred out of the Kent County jail.
Benjamin Malachino, 17, will go to Pine Rest Christian Mental Health Services in Gaines Township for treatment as the judicial process moves forward.
Authorities say Malachino sent text messages to a female student threatening to sexually assault her, lock down Comstock Park High School and kill several students -- three of whom he mentioned by name.
He has been ordered to undergo psychological, competency and criminal responsibility exams before his court case moves forward.
At a Tuesday morning hearing, Malachino's family and attorney asked 63rd District Chief Judge Sara Smolenski to let him move to Pine Rest, but the judge had concerns about the facility's security.
"What's paramount is the safety of the community and the safety of the public, that's the biggest concern," said Smolenski. "In light of some of the events in our world in the past few months, this is highly, highly power of focus on this task has to be of high seriousness and concern. Having said that, I'm not convinced that he wouldn't still be secured at the Pine Rest."
After some discussion, the judge allowed the move, but also set several strict rules. Malachino must be in a fully-secured area at all times and must comply with treatment. If he doesn't, he will be sent back to jail.
Malachino will only be allowed phone calls and visitation from family members and his attorney.
Kent County correctional staff will handle the transfer, which will happen as soon as Pine Rest is prepared to receive Malachino.
