GRAND RAPIDS, Mich. (WOOD) - A Van Buren County judge has reversed the decision to drop the charges against a Portage teacher accused of driving drunk with her kids in the back seat.
The charges against Leslie Buscher were dismissed at the district court level after her attorney argued that Buscher's vehicle was not parked on the roadway and that there was no evidence that Buscher was ever driving the vehicle she was found in.
Prosecutors immediately filed an appeal and made arguments before a circuit court judge last Friday to have the charges reinstated.
A circuit court judge ruled this week to have the charges reinstated.
Buscher, a 37-year-old Portage resident, was arrested in July after Van Buren County Sheriff's deputies found her in an SUV north of the intersection of County Road 652 and Red Arrow Highway, police said.
They say she was slumped over the steering wheel of the SUV. Two children, ages 2 and 4, and a party cup half full of vodka were found inside the vehicle.
Buscher was unresponsive when police found her.
Buscher was a teacher at Lake Center Elementary school in Portage at the time of her arrest. She has since been reassigned within the district, school officials said
