GRAND RAPIDS, Mich. (WOOD) - Thomas Foley, convicted in 2009 of killing his wife, will receive a new trial after a ruling by the state Supreme Court.
Earlier this year, a state appellate court ruled Foley could get a new trial because of new evidence, but that decision was appealed by a prosecutor and the Supreme Court says it won't consider the appeal.
Foley was convicted of the first-degree murder in November 2009. DeeDee Foley, his wife, was a second-grade teacher at Union City Community Schools. She died from a 12-gauge shotgun blast on Feb. 7. Thomas Foley later called police and said he found his wife's body.
The couple shared a home in Girard Township.
24 Hour News 8 reached out to a number of the jurors who sat on the original trial.
None of them wanted to go on camera, but all of them who agreed to speak said they felt strongly that they made the right decision in Foley's conviction.
Jurors said the evidence regarding a car is not new, and that they heard about it at the first trial.
Foley's story about what happened the day of DeeDee's slaying had a lot of holes and was not credible, they added. They feel he should remain in prison.
Foley's new trial is scheduled for July 12.
