MUSKEGON, Mich. (WOOD) - Mike D'Oyly, the ex-choir accompanist for Mona Shores High School, was bound over for trial on criminal sex charges on Wednesday.

D'Oyly, 54, was in court in Muskegon for his preliminary exam on one count of fourth-degree criminal sexual conduct.

D'Oyly's victim, who 24 Hour news 8 will not identify, took the stand in the hearing.

He said D'Oyly would, "slide his hands down my back and firmly grab my butt."

The alleged victim did not have a specific date or time that these incidents happened, saying only they were on an ongoing basis during his junior and senior years.

"When he would hug me he would take in deep breaths, and make his grasp more firm on his hugs, and he would... I could hear him take a breath in and smell me," said the victim. "Sometimes he would respond, 'You smell good.'"

Though D'Oyly's defense attorney Fil Iorio argued the prosecution hadn't made its case, the judge "respectfully disagreed" with him.

The judge found enough evidence to send him to trial.

The investigation started on New Year's Eve when a concerned parent of a former Mona Shores High School student contacted the school.

Less than a month later, Tague said four victims have come forward, and their investigation will continue.

Additional charges -- another fourth-degree CSC and one count of second-degree CSC -- were also filed in court Wednesday.  Second degree CSC is a felony charge that carries a potential 15 years behind bars.

24 Hour News 8 heard the warrant being sworn in court Wednesday for one of the subsequent counts. A Norton Shores Police detective told the judge that another victim "could feel that Mr. D'Oyly was getting an erection from [a dance he was doing] and pretended to spank his butt while he was doing it for the entire song."

All of the alleged incidents happened between Aug. 1, 2008 and Dec. 31, 2011.

D'Oyly is also under investigation in Oakland County for CSC charges.

It's alleged he took two current students to Oakland County on separate trips and that he shared a bed with each student.

Tague said authorities are currently investigating if anything improper happened between D'Oyly and kids outside of the Muskegon area.

"The investigation is revealing a pattern of enticing young boys, not only to befriend him, but to go to locations outside the school system," said Tague. "Unfortunately, we now have five different children alleging that he took them out of Muskegon County to a different location and engaged in sexual activity."

Tague said if inappropriate conduct is discovered to have happened outside of Muskegon, they will bring in other authorities to investigate.

With the new charges D'Oyly now faces, Tague said he is being held on a combined bail of $875,000.

His attorney had asked that his client's bond be lowered to a "personal recognizance" bond. He highlighted his client's clean criminal record and said he was not a flight risk.

"He's not going to go anywhere," said defense attorney Fil Iorio. "He's going to defend his good name against these baseless charges."

But both the judge, and prosecutors, said they feel safer with D'Oyly behind bars.

"Based on the fact that we do have several victims at this point, we feel that [D'Oyly's] a danger to young people," said Tague. "The evidence that we've gathered, that has already been disclosed at the arraignment, shows extremely bizarre sexual behavior on his part and particularly focused on young children. So certainly, we feel that he is a danger, and I think the judge agreed with that position."

On Jan. 12, Mona Shores Superintendent Dave Peden told 24 Hour News 8 D'Oyly is no longer employed by the district. Because of the ongoing due process, he could not indicate whether D'Oyly resigned or was fired.
