GRAND RAPIDS, Mich. (WOOD) - The Kent County Prosecutor's office won't file criminal charges against Jay Spencer, the sole candidate for Plainfield Township Supervisor in Tuesday's election.

Some family members asked the Kent County Sheriff's Department to investigate the way Spencer handled the trust estate of their father, the late Norman Boike. They say Spencer, as trustee, loaned   $28,000 from the trust account to his businesses.

Chief Assistant Prosecutor Chris Becker said he reviewed the results of the investigation and said there appeared to be nothing criminal in what Spencer did. He said trust documents indicate he could lend money to anyone in the family. Spencer is reportedly married to a granddaughter of the late Norman Boike.

Spencer reportedly paid the money back. The issue is still being contested in Probate Court.  

In a separate matter, Circuit Court documents show a Nevada company is trying to collect a judgement against Spencer for failing to pay royalties on the purchase of a real estate business.
