GRAND RAPIDS, Mich. (WOOD) - The man accused of having sex without revealing that he's HIV positive will remain at Kent County jail for now.
Jeremy Merithew, the Plainfield Township man, motioned to dismiss his case. He argued that Michigan's "Failure to Inform" law is unconstitutional because it violates his rights to free speech and privacy.
Judge Robert Redford ruled against Merithew's motion on Friday morning. Redford said the law is "straightforward and entirely rational." Redford recently raised Merithew's bond while deputies investigate whether the 32-year-old has been trolling for online sex again.
