Ruled competent after testing

WALKER, Mich. (WOOD) - Jack Jacqmain, who was recently ruled competent to understand the charges against him, was ordered to stand trial for the August 2010 stabbing death of an Indianapolis man at a Walker motel.

Witnesses at a preliminary hearing Friday said they saw Jacqmain brutally stab and kill Indiana businessman Mark Moore at a Walker Motel 6.

Mark Nozicka testified he witnessed the stabbing as he was driving into the motel's parking lot. He said he saw a scuffle between Jacqmain and Moore on a balcony.

Nozicka said he saw Jacqmain use an uppercut motion and casually walk away with a knife, and that he saw Moore bent in pain as he said, "I'm going to die."

Three other minor witnesses filled in some details to help the prosecution show probable cause to go to trial.

The hearing was a continuation from earlier this month when it was determined Jacqmain was competent to participate in his own defense.

Jacqmain failed competency tests for months until the most recent test.

His defense lawyer, Valerie Foster, agreed there was sufficient evidence for probable cause, but said she'll bring up his mental issues in future court proceedings.

Competency and criminal responsibility are two different things, Foster said.

She said Jacqmain would keep being evaluated for criminal responsibility.
