BATTLE CREEK, Mich. (WOOD) - A hearing to determine whether Lorinda Swain will get a new trial took place on Tuesday in a Calhoun County courtroom.
In October, the Michigan Court of Appeals ruled there should be a hearing on new evidence in the Swain case. She was convicted in 2002 on four counts of first-degree criminal sexual conduct in the molestation of her then-13-year-old son. Swain was released from prison on an appeal in August 2009 after her son, Ronnie, recanted his story.
In this evidentiary hearing, her former boyfriend - who lived in the home at the time of the alleged assault - was expected to testify he told police the abuse never took place, but that information was never given to the defense before the original trial began. The ex-boyfriend was never interviewed by Swain's original attorney.
Judge Conrad Sindt, who has presided over most of the Swain case, presided over the hearing.
The hearing was continued to Feb. 3 at 8 a.m.
Swain remains out on bond.
