GRAND RAPIDS, Mich. (WOOD) - Three men are in custody after they allegedly tried to rob a medical marijuana operation on the northeast side of Grand Rapids - which police now say was an illegal operation.

The homeowner of the targeted house - in the 2600 block of Foster, near Conger - called police around 10:40 a.m. and said three men burst in with guns and tried to rob him, allegedly in pursuit of the marijuana.

Once police arrived at the house, the suspects ran and were chased by police. That foot chase briefly put Northpointe Christian Elementary on lock down. It re-opened very quickly.

The homeowner was able to escape to his neighbor's house during the incident. No one was hurt.

While police were inside the house, they found marijuana plants being grown. The brother of the homeowner, Kevin Weindorf, told police he was a licensed care giver under the Michigan Medical Marijuana Act . But the homeowner would not allow police to search the house without a warrant.

Once they got the warrant, they went inside and began carting off what they claim is evidence of a growing operation larger than what is allowed by the law.

"Based on a number of factors including the number of plants, how they were stored,and how they were processed and what was readily available to people other than the caregivers we believe that they were not compliant and indeed produced and manufactured marijuana," GRPD Vice Unit Commander Richard Nawrocki told 24 Hour News 8.

Kevin Weindorf  told 24 Hour News 8 he is in compliance with the law and believes he will prevail in the courts.
No charges were filed against him.

But the three men in custody are awaiting charges for armed home invasion.
