GRAND RAPIDS, Mich. (WOOD) - The mother of a toddler killed in February 2010, whose body was then disposed of in a commercial Dumpster, signed papers this week, releasing all her rights to her other child, 2-year-old Bryan Malmberg.
A judge signed Connie Martinez's termination of rights order Wednesday, according a clerk from Judge Carpenter's office.
Bryan was in foster care prior to the hearing, and will remain there for now.
Martinez's daughter, 2-year-old Jozlynn Martinez, died last year when Connie's boyfriend kneeled on the toddler's chest after she had a temper tantrum. Jeffrey Malmberg then threw away her body, and police say Jozlynn was likely incinerated at a waste-to-energy facility.
Her body has never been found. Malmberg is in prison for up to 90 years for the incident.
In March 2010, a Kent County court referee ruled the state should have temporary custody of Bryan.
At that time, the state alleged in a court document obtained by 24 Hour News 8 that Martinez showed poor judgment when she allowed an alleged killer to remain in her home, despite concerns he was abusing her children.
During a trial, the court said the boy should live in foster care, under the supervision of the Department of Human Services, according to the court referee.
Child Protective Services had removed the boy from his mother's home shortly after Jozlynn disappeared in February 2010.
