GRAND RAPIDS, Mich. (WOOD) - Jeffrey Malmberg will stand trial for allegedly murdering 2-year-old Jozlynn Martinez, a judge ruled following Malmberg's prelimary exam on the charges.
Malmberg, 40, is charged with second-degree murder, tampering with evidence for tossing Jozlynn's body in a Dumpster and larceny for stealing $2,800 from the girl's mother.
Prosecutors used Malmberg's own words against him in a hearing in Grand Rapids District Court related to the toddler's death Feb. 22.
Kent County Assistant Prosecutor Chris Becker played portions of tape-recorded interviews conducted by police in which Malmberg allegedly confessed the crime.
Malmberg told police he knelt on Jozlynn's chest until she died, then placed her body in a trash bag and carried her two blocks to a commercial Dumpster.
Despite searches at the Kent Waste-to-Energy Facility, the South Kent Landfill and sewers in the family's West Side neighborhood, police haven't been able to find Jozlynn's body.
Before the hearing, defense attorney Jeffrey Kirchhoff today asked that 24 Hour News 8 reporter Ken Kolker be sequestered as a possible witness. Kolker interviewed Malmberg at the Kent County Jail. In that interview, Malmberg said the death was an accident, though he didn't provide details.
