GRAND RAPIDS, Mich. (WOOD) - The appeal of a man who admitted to trying for a second time to hire someone to murder his ex-wife while in prison has been denied.
Albers was already serving prison time for trying to hire someone to murder his wife Andrea while the two were still married. He had tried to hire a hit man between 2009 and 2010 and was sentenced to nine- to 30 years in prison.
But while in prison, he learned about someone who could find a hit man to try and kill her again. He was then tried and convicted at the federal level.
The U.S. Court of Appeals denied David Albers' appeal on July 13. Albers argued his 10-year federal sentence for murder for hire should shortened and should not run consecutive to his state sentence for a similar crime.
The earliest Albers could be released from his state sentence is July 2017. Once released from a Michigan prison, he will being serving his 10-year federal sentence.
He was transferred from Ionia to a Muskegon prison in April.
